KHUMS

AYATOLLAH ABUL QASIM AL KHOI

1843. Khums should be divided into two parts Sayyids* are "titled to get one part of it and it should be given to a sayyid who is indigent or an orphan or who has become penniless while travelling. The second part belongs to the holy Imam and during the present time it should be given to a fully qualified mujtahid or spent for such purposes as may be confirmed by that mujtahid. In case, however, a person gives the share of the holy Imam to a mujtahid whom he does not follow he should, on the basis of obligatory precaution, obtain permission in this behalf from the mujtahid whom he follows and such a permission will be accorded only when he knows that both the mujtahids spend the share of the holy Imam in one and the same manner.

1848. If a person says that he is a sayyid Khums should be given to him only when two just (Aadil) persons confirm that he is a sayyid or if he is so well known among the people. (as sayyid) one should become sure and satisfied about his being a sayyid

1843. * Khums should be divided into two parts. One part is Sehme Sadaat, it should be given to a Sayyid who is poor, or orphan, or who has become stranded without money during his journey. The second part is Sehme Imam (A.S.), and during the present time it should be given to a Mujtahid, who fulfils all conditions, or be spent for such purposes as allowed by that Mujtahid. As an obligatory precaution, that Mujtahid must be Aalam, and well versed in public affairs.

1848. If a person claims that he is a Sayyid, Khums cannot be given to him unless two just ('Adil) persons confirm that he is a Sayyid, or if he is so well-known among the people, (as Sayyid) that one is sure and satisfied about him being a Sayyid.

AYATOLLAH SYED MOHAMMED RAZA MOOSVI GULPAYEGANI

1843. * Khums should be divided into two parts. One part is Sehme Sadaat, it should be given to a poor Sayyid, or orphan Sayyid, or a Sayyid who has become stranded without money during his journey. The second part is Sehme Imam (A.S.), and during the present time it should be given to a Mujtahid, who fulfils all conditions, or if it is given to that Mujtahid whose Taqlid is done by him than in that case he is given permission to give him if he knows that the Mujtahid whose taqlid is being done and that Mujtahid whom he wanted to give it, both will spend the Sehme Imam (A.S.) in the same way.

IMAM KHOMEINI

On page no. 483 question no. 5. At the time of exercises a special type of music is played. Is this act Lawful?  In the same way is it lawful or not the drums, instrument of music which is played in military?

Answer: It is wrong if it is included in the majalis (gathering) of entertainment.

TRADITION OF THE INFALLIBLES AS

1.       Traditionalist narrated to Imam Abu Abdullah AS that he said “Do you know from where does the adultery enters into the people, I said I do not know. Imam AS said that is due to non payment of Khums to us who are Ahlebait AS. But our shias who pay the Khums, their children shall be lawful”.

2.       Traditionalist narrated to Imam Jaffer Sadiq AS that he said “The day of Judgment will be hard for the people when the Personage of Khums i.e. Imam AS will stand up and pray “O My Lord My Khums” that is He will ask for his right. And we have made it righteous for our shias so as their children become righteous.

WaAAlamoo annama ghanimtum min shayin faanna lillahi khumusahu walirrasooli walithee alqurba walyatama walmasakeeni wabni assabeeli …

8:41 And know that out of all that ye may acquire, a fifth share is assigned to Allah,- and to the Messenger, and to near relatives, orphans, the needy, and the wayfarer,-

Tafseer:- In the books Kaafi and Tahzeeb it is narrated to Imam Ali AS that “We are meant by walithee alqurba in this verse whom Allah has joint along with His being and His Prophet. And by walyatama walmasakeeni wabni assabeeli our orphans, needy and wayfarer are meant. That is why Allah has not fixed any share in sadaqat for us and this way Allah has showered His mercy on us and His Prophet SW by saving us from eating the rubbish of the people”. In the book Tahzeeb it is narrated to Imam Mohammad Baqir AS that “The shares in the Khums of Allah, Prophet SW and walithee alqurba (because of the relation to the Prophet) is the right of the Imam AS and by walyatama the orphans of the Progeny of the Prophet SW are meant and by walmasakeeni wabni assabeeli the needy and the wayfarer and travelers of the Progeny of the Prophet SW are meant.  Thus Khums shall not be given to others than them.

In the book Tafseer Qummi it is being narrated that out of all that ye may acquire, a fifth share is assigned for Khums and which shall be divided into 6 shares. Thus one will be for Allah,- one will be for the Messenger, one will be for the Messenger’s near relatives which are Imams AS. Thus Imam is inherited for the shares of Allah and His Messenger. This way out of six shares, three will be for Imam AS and the remaining three shares will be for the orphans, the needy, and the wayfarer of the Progeny of the Prophet SW. Now out of the six shares the three have been assigned to the Imam AS because it is the responsibility of the Imams AS the same way as Allah has made the Prophet SW responsible for the well being of the orphans, helping muslims, payback their debts, arrange for them things which are required in Haj and Jehad.  

It is also proved with the saying of the Prophet SW when Allah has revealed this verse unto him in which Allah has said that “The Prophet SW has authority on the lives of the Momineen more than them and Prophet SW is the Father of Momineen”. When Allah has made the Prophet SW the father of Momineen then he will be the same way responsible for them as the father will be for his sons. Thus at that time the Prophet SW said “Whoever leave behind his wealth it is for his successors and whoever leave behind a debt I will be responsible for its repayment and if a person leave behind his property and if there is no successor to it then that property will be handed to me. Thus how the Eminence of the Prophet SW was there the Eminence is same for the Imams AS. That is why out of six shares three are fixed for Imam AS.

Note:- All the Mujtahids are of the opinion that Khums have two sections, One section is for Sadaat. But the saying of the Mujtahids that during the present times the section of Imam AS be given to the Mujtahids and to this claim they are unable to present one hadith in which it is obligatory to give the section of Imam AS Khums to the Mujathid.

In the verse of Quran

Innallah la yagferu ayn yushreka behi wayagfir ma doona zalika lemaiyashao

Indeed Allah will not forgive those who do shirk and other than these He will forgive those whom He wanted to.

Tafseer:- In the tafseer Ayaashi it is narrated to Imam Mohammad Baqir AS in the tafseer of this verse it has been said “The meaning of Innallah la yagferu ayn yushreka behi is that Allah will never forgive that person who rejects the wilayath of Ali AS. The meaning of wayagfir ma doona zalika lemaiyashao is that He will forgive them who are friends of Ali AS.

It has been asked to Imam Jaffer Sadiq AS that what is the initial form of Shirk is? Imam AS replied “Adding from themselves one thing in the religion and do friendship and enmity with the people on it.

In the Book Tawheed it is being narrated to Imam Ali AS that he said “I love this verse more than any verse in the Quran.

In the light of this verse and its tafseer of the Infallibles all the Mujtahids has turned out to be Mushriks. Their further sayings after claiming to be Nayeb of Imam AS that If a person says that he is a sayyid Khums should be given to him only when two just (Aadil) persons confirm that he is a sayyid  Then it is to be noted by every intellectual person that when Ayatullah Mohammad Ali Araki who is confirmed non Sayyid then how come he is eligible for the Sahem Imam? And how can anybody do taqlid of a Mushrik?

We had also very open proved for the intellectual person that in the way how the share of Allan and His Prophet SW has been assigned to the Imam AS that is un- presents share have been assigned to the present. The righteous share holder of the Khums who is present and is in hiding but before going into hiding he has allowed his assigned share in favor of Shias.  And in this Hadith there is no were given that it is meant for Mujtahids.
