1740. The 1st date of a month is not proved by the order of a
religious leader (Mujtahid) and it is better to observe precaution.
1741. The first date of a month is not proved by the
prediction of the astronomers. However, if a person believes in what they say
or is satisfied with it, he should act according to their statement.
1742. If the moon is high up in the sky, or sets late, it is
not a proof that it appeared in the previous night. However, if the moon is
seen before noon, that day will be treated to be the 1st of the month (i.e. it
will be assumed that the new moon appeared in the previous night.) Similarly if
there is a halo round it, it indicates that the new moon appeared in the
previous night.
1744. If the first date of a month is proved in a city it is
also proved in other city whether they are near or far and whether or not they
have a common horizon, provided they have a common night, even though when it
is the first part of the night in one of them it is the last part of the night
in the other.

their findings, he should act accordingly.

the previous night was the first night of the month. Similarly, if there is a

night

* If the first day of a month is proved in a city, it is also proved in other
cities if they are united in their horizon. And the meaning of having a common
horizon in this matter is that if new moon was sighted in a city, there would
be a distinct possibility of sighting it in the other cities, if there were no
impediments, like, the clouds etc.

1740. When the Mujtahid declares the 1st day of any month,
it will be obligatory on a person to abide to it if he is not in the taqleed of
that Mujtahid also. And if somebody knows that the Mujtahid had done some
mistake then he cannot follow him.

1727. The Hakim e Sharah Should declare the 1st day of any
month.( Hakim e Sharah means a Mujtahid).

TRADITION OF THE INFALLIBLES AS
1.
It is narrated by Mohammad bin Muslim to Imam Mohammed Baqir AS that He has
said ” Fast when you sight the new moon
of the month of Ramzan, and stop fasting when you sight the new moon (month of
Shawal). This neither happens on anybody’s opinion or guesses nor on a
situation where ten persons are standing to sight the moon and from them if one
says there it is (moon) and other nine says they have not sighted it because if
one sees it thousand can see it.

It is narrated by Fazal bin Osman to Imam Jaffer Sadiq AS that He has said that
the Prophet SW said “There is no obligation other than seeing for Ahle Qibla
and there is no obligation on Muslims other than to sight the moon.

It is narrated by Halbi to Imam Jaffer Sadiq AS. Imam AS said “Imam Ali AS use
to say evidence of sighting a new moon without the witness of two Just persons
is wrong”.

Samaya has asked Imam AS about the day in which people differ, Imam replied “If
the denizens of a city on the basis of sighting the new moon and if 500 of the
denizens of a city assemblage then fast”.

Mohammad bin Marazim from his father narrates this to Imam Jaffer Sadiq AS that
He said “If the new moon becomes like a ring (tauq) then it is of 2nd
night and if it shadows head then it is of the 3rd night”
6. It is
narrated by Hamad bin Isa and he by Ismail bin Hur to Imam Jaffer Sadiq AS that
He have said “if the new moon disappears before the afterglow then it is of the
same night (first night) and if it disappears after the afterglow then it is of
the second night.
